Family law has the particularity that the parties involved are often in an emotionally charged situation. It is therefore important to us not only to provide you with expert advice and assert your interests, but also to support you in resolving conflicts individually and - where possible and desired - out of court, including through mediation.
Ms. Montjoie specializes not only in national family law, but also in international family law. International family law is involved if one or both of the spouses is not a German citizen and/or the spouses are living abroad.
Ms. Montjoie also has particular expertise in the drafting of (international) prenuptial agreements and agreements on the consequences of divorce.
Family law regulates the legal relationships of persons bound together by marriage, civil partnership, family and kinship and thus goes far beyond the execution of divorce. However, issues relating to the consequences of marriage and separation take up a great deal of space in practice:
- Separation, divorce and divorce consequences:
- Separation maintenance and divorce maintenance
- Division of household effects, allocation of the matrimonial home or house
- Property settlement
- Implementation of pension equalization ("pension equalization")
- Child maintenance
- Parental custody
- Rights of access
- Drafting agreements on the consequences of divorce
Mediation
In suitable cases, mediation can be an effective and inexpensive alternative to court proceedings. This presupposes that all parties to the conflict decide in favor of mediation in order to work out an amicable solution to their conflict in a self-determined and independent manner. The task of the mediator as a neutral intermediary is to establish a level of discussion between the parties within the framework of a structured and confidential procedure and to promote interest-oriented communication. However, the mediator does not make any decisions. In mediation, the parties do not delegate their dispute to lawyers and judges, but retain control of the conflict resolution themselves. This creates more scope for economically optimized, sustainable and interest-oriented results.
